3. Product Information and Availability
We strive to ensure that all information about our products and services, including descriptions, pricing, and availability, is accurate and up-to-date. However, errors may occur. Prairie Sands reserves the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. Products and services are subject to availability, and we cannot guarantee that items displayed on our online platform will always be in stock.
4. Pricing and Payments
All prices listed on our platform are in Canadian Dollars (CAD) unless otherwise stated. Prices are subject to change without notice. For custom timepieces, a detailed quote will be provided and must be approved before work commences. Payment for all products and services must be made in full before delivery or completion, unless otherwise agreed in writing. We accept various payment methods, which will be specified at the point of purchase.
5. Custom Orders and Consultations
For custom-designed timepieces and personal watch consultations, a clear scope of work and design specifications will be agreed upon in writing between the client and Prairie Sands. Any changes requested after the agreement may incur additional charges and affect delivery timelines. Deposits for custom orders are generally non-refundable once design and material procurement has begun.
6. Watch Repair and Restoration Services
When submitting a watch for repair or restoration, clients will receive an estimate. Final costs may vary depending on unforeseen complications or parts required. Prairie Sands takes utmost care in handling all timepieces but cannot be held responsible for existing damage not noted during initial assessment, or for issues arising from conditions outside our control. A warranty on repair work will be provided at the time of service, typically covering the specific work performed and parts replaced.
7. Intellectual Property
All content on our online platform, including but not limited to designs, text, graphics, logos, images, and software, is the exclusive property of Prairie Sands or its content suppliers and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission. For custom designs, while the timepiece is yours upon purchase, the underlying design and intellectual property remain with Prairie Sands.
8. Limitation of Liability
To the fullest extent permitted by law, Prairie Sands shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use our services; (b) any conduct or content of any third party on our services; or (c) unauthorized access, use, or alteration of your transmissions or content.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.
